Upon access and utilization of our goods and services, you hereby agree to adhere to the conditions and provisions listed herein. Your use of our products and services (“Services”) is greatly appreciated. inSOCIAL is a product of Insocial LLC, a registered entity in the state of New Jersey, and headquartered in Phillipsburg, NJ, United States of America.

ASSOCIATION WITH INSTAGRAM

inSOCIAL is a standalone entity, with no sponsorship or affiliation with Instagram, Facebook, or any third-party partners associated with Instagram. inSOCIAL maintains an objective distinct from the tarnishing of the INSTAGRAM brand or trademark. The operation of inSOCIAL is entirely separate and independent from Instagram. We at inSOCIAL do not seek to unfairly exploit the reputation of Instagram. Any perceived similarities between the trademarks of inSOCIAL and Instagram are incidental and do not imply any formal partnership. These domain names and trademarks are owned and operated by separate legal entities.

INTELLECTUAL PROPERTY RIGHTS

All intellectual property rights concerning our services, including but not limited to design, text, graphics, and other content, are the sole property of inSOCIAL. Users are granted a restricted license to utilize the service for its intended purpose only. Any reproduction or utilization of any part of the services for other reasons without express written permission is strictly prohibited.

SERVICE DELIVERY

To utilize the services of inSOCIAL, a prerequisite of registration for an account, creating a username and password, is required. By registering, you acknowledge and agree that you bear full responsibility for all activities under your username and password. The Services facilitate the analysis of your social account's promotion, usage of our chat including chatbot and CMS system, interaction with clients, and submission of related information, text, and files. Upon receipt of payment for the applicable fees, login instructions for inSOCIAL Services will be delivered to your account or through other reasonable means without delay. You are obligated to access your account to verify payment receipt and successful order processing. All deliveries under these Terms will be electronic.

ADDITIONAL TERMS

It is your exclusive responsibility to comply with Instagram rules and any legislation you are subject to
inSOCIAL is to be used at your own risk
inSOCIAL disclaims responsibility for your actions and their respective consequences
We do not acknowledge responsibility if your Instagram account is banned for any reason
Your Instagram username and password are necessary to retrieve the required information for Instagram API
We assure you we do not store, misuse, or distribute your password to any third parties
The risk of losing your Instagram account is present when working with that account via our system, which is not official and not approved by Instagram
You are to acknowledge all risks and bear the responsibility for using your Instagram account via our system

ACCOUNT TERMS

This service is intended for users who are 13 years of age or older
Only human users are permitted
Accounts registered by automated methods, including "bots," are prohibited
A valid email address and any other requested information must be provided to complete the signup process
Each login is designated for individual use sharing a single login among multiple people is not permitted
However, separate logins for multiple people as permitted by your plan can be created
You bear the responsibility for the security of your account and password
inSOCIAL will not be liable for any loss or damage arising from your noncompliance with this security obligation
You will be held responsible for all content posted and activity that occurs under your account (even when content is posted by others who have access to your account)
No person or legal entity may maintain more than one trial account
Any illegal or unauthorized use of the service is prohibited
In using the service, you must not violate any laws in your jurisdiction

SINGLE PURCHASE AND SUBSCRIPTION AGREEMENT

By procuring our services, whether through a single purchase or a subscription, you acknowledge that you understand the nature of the purchase and agree not to raise any fraudulent disputes through PayPal or any other payment systems
A legitimate credit or debit card is required for the transaction
For single purchases, payment is made for a onetime transaction, and any fees associated with the purchase are nonrefundable, unless under exceptional circumstances
Your subscription will automatically renew at the commencement of each new month, and you reserve the right to cancel your subscription at any time
Please note that any payment made towards a new subscription is nonrefundable, unless under exceptional circumstances

REFUND PROTOCOL

Unless under exceptional circumstances, subscription fees for our services are non-refundable. If you consider a refund to be justified, we encourage you to reach out to our customer service to address your concern.

TERMINATION AND CANCELLATION

You alone bear the responsibility for properly terminating your account
However, you may request account termination by contacting our support via email
In the event you decide to discontinue the service before the conclusion of your currently paidup month or if you cancel your single purchase, your cancellation will take immediate effect, and you will not be subjected to further charges
Should you terminate your subscription prior to the completion of your current billing cycle, your cancellation will take effect at the onset of the ensuing billing process
Until that time, you retain access to our services

SERVICE AND PRICE MODIFICATIONS

We reserve the right to modify, suspend, or withdraw the entirety or any part of our services or their content at any time without notice and without any liability
Monthly subscription costs and prices for single purchases are subject to modification without prior notification from inSOCIAL
Information about new pricing will be provided by posting to the inSOCIAL website
However, any changes in pricing will not impact your current paid period
inSOCIAL shall not be held accountable to you or any third party for any modification, price adjustment, suspension, or discontinuation of the service

GENERAL TERMS

Your utilization of the service is at your sole risk
The service is provided on an "as is" and "as available" basis
The anticipated quantity of followers, likes, and comments is not assured
It largely depends on the quality and interest level of your content
While we do draw the attention of genuine users to your feed, we cannot protect you from spam, fake, or inactive followers
Although it is impossible to completely prevent them, you can eliminate unwanted followers independently or through specialized services
We do not guarantee the services' continuous, uninterrupted, or errorfree operation
Support for the services is exclusively available in English via email
You are prohibited from altering, adapting, or hacking the service or falsely associating it with the inSOCIAL services through modification of another website
Verbal, physical, written, or other abuse (including threats of abuse or retribution) directed at any inSOCIAL customer, employee, member, or officer will result in immediate account termination
You acknowledge that inSOCIAL employs thirdparty vendors and hosting partners to furnish the hardware, software, networking, storage, and associated technology necessary to operate the service
You understand that Instagram may request you to confirm your account using a code delivered by SMS or other means
inSOCIAL bears no responsibility if you fail to receive the SMS and consequently cannot unlock the account
Your payment is nonrefundable in such circumstances
The remaining paid period can be transferred to another account if a request is submitted to us at support@insocial

If your bandwidth usage or load substantially exceeds the average bandwidth usage (as solely determined by inSOCIAL) of other inSOCIAL customers, we reserve the right to instantaneously disable or limit your account until you can diminish your bandwidth consumption or load
inSOCIAL does not warrant that (I) the service will meet your specific requirements, (II) the service will be uninterrupted, timely, secure, or errorfree, (III) the results that may be obtained from the use of the service will be accurate or reliable, (IV) the quality of any products, services, information, or other material purchased or obtained by you through the service will meet your expectations, and (V) any errors in the service will be corrected
You expressly understand and agree that inSOCIAL shall not be liable for any direct, indirect, incidental, special, or consequential damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses (even if inSOCIAL has been advised of the possibility of such damages)

DATA PRIVACY AND SECURITY

For the purposes of Instagram API, we require your Instagram username and password. This data is exclusively used for this purpose and is not stored, shared, misused, or distributed to any third parties. We comply with all pertinent data protection laws in our handling of your data and have implemented robust security measures to protect it.

LIMITATIONS OF LIABILITY

You expressly understand and agree that inSOCIAL shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data, or other intangible losses resulting from the use of or inability to use the service.

INDEMNIFICATION

FORCE MAJEURE

inSOCIAL shall not be held liable for any delays or failure in performance of any part of the service, from any cause beyond our control. This includes, but is not limited to, acts of God, changes to law or regulations, embargoes, war, terrorist acts, riots, fires, earthquakes, nuclear accidents, floods, strikes, power blackouts, volcanic action, unusually severe weather conditions, and acts of hackers, or third-party internet service providers.

GOVERNING LAW AND DISPUTE RESOLUTION

These terms and conditions are governed by and construed in accordance with the laws of United States of America. Any disputes relating to these terms and conditions shall be subject to the jurisdiction of the courts of NJ (New Jersey). If any provision of these terms and conditions is found by any court or other competent authority to be invalid or unenforceable, that provision will be limited to the minimum extent necessary so these Terms and Conditions will otherwise remain in effect.

CONSEQUENCES OF VIOLATIONS

In the event of a violation of these terms, we reserve the right to terminate or suspend your access to our services, at our discretion. In such a case, we may attempt to contact you to clarify why we have taken such action and what remedial steps, if any, you can take.
